President Obama Nominates Merrick Garland, Not That Anyone Will Confirm Him.

Hold onto your butts. This morning, President Barack Obama nominated Merrick Garland to replace Justice Antonin Scalia on the Supreme Court. It was a savvy pick on the President’s part: Garland is a well-respected chief judge of the United States Court of Appeals for the District of Columbia Circuit. He’s centrist, hugely credentialed and has no easy scabs for the Republican Senate to pick at. In fact, earlier this week, Senator Orin Hatch said “Obama could easily pick someone like Merrick Garland, who is a fine man, but he probably won’t do that…”

That sort of gravy was probably just irresistible to the President. Nevertheless, Senator Mitch McConnell followed through on his earlier promise to not even entertain the thought of seriously considering an Obama nominee, saying: “The next justice could fundamentally alter the direction of the Supreme Court and have a profound impact on our country, so of course the American people should have a say in the court’s direction.”

One has to assume that Obama expected this, which is why he nominated such a stately, middle-of-the-road candidate. It’s hard to not see this move as a White House strategy to make the Republican party look unreasonable for refusing to consider such an olive branch of a nominee (as Senator Chuck Schumer said: “If Merrick Garland can’t get bipartisan support, no one can”), giving would-be President Hillary Clinton more leverage when it’s her turn to make a nomination.
